Terms of Service

Clinch monitors the public web pages of competitors you choose, detects changes, interprets them with AI in the context of your company, and delivers battlecards, briefs, a weekly digest and, on the Pro plan, a connector that lets Claude read and write your workspace. These terms are an agreement between you (and the company you represent) and Clinch. By creating an account you accept them and our Privacy Policy.

You need a work email and a password. Keep them private and tell us at once if you think your account has been used without permission. You must be at least 18 and authorized to bind the company whose workspace you create.

The person who creates a workspace is its owner. Owners can invite teammates up to the plan's seat limit, remove them, change workspace settings and billing, and delete the workspace. Owners are responsible for their team's use of Clinch and for the content their team enters. Members can view everything in the workspace and log deals and mentions; they cannot change billing or workspace-wide settings.

• Trial. New workspaces get 14 days free with Pro features (15 competitors, 10 seats). No card is needed. When the trial ends, monitoring, digests and the Claude connector pause until you pick a plan; your data is kept.
• Clinch at $79 per month: 5 competitors, 5 seats, daily monitoring, battlecards, briefs and the weekly digest.
• Clinch Pro at $149 per month: 15 competitors, 10 seats, everything in Clinch, plus the Claude connector, plugin and workflows.

Subscriptions are billed monthly in US dollars through Stripe and renew automatically until cancelled. Prices exclude any taxes we are required to collect. We may change prices with at least 30 days notice by email; the change applies from your next renewal.

Cancelling and downgrading. Cancel or change plan any time from Settings > Billing, which opens the Stripe customer portal. Cancellation takes effect at the end of the current billing period and you keep access until then. Payments already made are not refunded for partial months, except where the law requires otherwise. If you move to a plan with a lower competitor limit, we pause the newest competitors above the limit rather than deleting them, and resume them if you upgrade again. Seats above a new limit stay active until you remove members.

Failed payments. If a charge fails we email the owner and Stripe retries the card for a few weeks. If it keeps failing the subscription is cancelled and the workspace returns to the paused state described for an ended trial.

Use Clinch to monitor public information about companies you compete with, for your own business. You agree not to:

• Point Clinch at pages you have no legitimate business reason to track, at private or login-protected pages, or at sites whose terms forbid automated access where you know that to be the case.
• Use Clinch to harass, defame or unlawfully surveil any person, or to collect personal data about individuals beyond what a normal sales process needs.
• Resell, republish or redistribute Clinch output as a product of your own, or use it to build a competing service.
• Probe, overload or interfere with the service, bypass plan limits or rate limits, or access another customer's workspace.
• Enter content into a workspace that you do not have the right to share, including material covered by an NDA that prohibits it.

You are responsible for the competitor URLs you add and for complying with the laws that apply to you, including data protection law for any personal data your team logs about prospects. We may suspend or end accounts that break these rules.

Battlecards, briefs, digests and change analyses are produced by AI from public web pages and the context you provide. They are working drafts for your team, not verified facts, legal advice or financial advice. Pages can be misread, competitors can change what they publish, and models can be wrong. Check anything you plan to say to a customer, put in a proposal or share publicly against the source, and never present Clinch output as a competitor's own statement. We are not responsible for decisions made on the basis of AI output. Where our analysis is clearly wrong, tell us; it helps us improve the prompts.

On plans that include it, you can authorize Claude to read your workspace and to write deals, mentions, competitors and profile details into it. Each write is recorded in an audit log visible to Clinch and attributed to the person who authorized the connection. Anything Claude writes is your team's content under these terms, so review what Claude proposes before confirming it. Your use of Claude itself is governed by Anthropic's terms. You can revoke Clinch's access from Claude at any time.

You own what you put into Clinch and what Clinch produces for your workspace. You give us the permission we need to store, process, display and email that content to your team, to send the relevant parts to our processors (for example Anthropic for analysis), and to show a battlecard publicly to anyone who has its share link. Third-party page content remains the property of its publishers; Clinch stores text snapshots to show change over time, and your use of that material should stay within fair use for competitive analysis.

Clinch, its software, design and brand belong to us. We may use aggregated, anonymized statistics (for example, how many customers track a given competitor domain) to improve the service; that never includes your workspace content or identifies you.

We aim for the service to be available at all times and monitor it daily, but we do not promise uninterrupted operation. Monitoring depends on competitor sites being reachable; pages that block automated access, require login or return errors may not be captured, and we tell you in the app when that happens. Support is by email at hello@getclinch.ai, normally within one business day.

Clinch is provided as is and as available. To the extent the law allows, we disclaim implied warranties, including fitness for a particular purpose and accuracy of AI output.

To the extent the law allows, neither party is liable to the other for indirect, incidental, consequential or punitive damages, or for lost profits, revenue or deals, however caused. Our total liability to you for all claims in any 12 month period is limited to the fees you paid us in that period. Nothing in these terms limits liability that cannot be limited by law, such as for fraud or willful misconduct.

You will defend and indemnify Clinch against third-party claims that arise from content your team enters, from your team's use of Clinch output, or from your breach of these terms.

You can stop using Clinch at any time by cancelling your subscription and, if you wish, deleting your workspace from Settings. We may suspend or terminate accounts that violate these terms, do not pay, or create legal or security risk, with notice where practical. On termination your right to use the service ends; sections on content, liability and disputes survive.

We may update these terms. For material changes we will email workspace owners or show a notice in the app at least 14 days before they take effect. Continuing to use Clinch after that date means you accept the new terms; if you do not, cancel before they apply.

If something goes wrong, email us first and we will try to resolve it within 30 days. These terms are governed by the laws of the place where the Clinch operating company is established, without regard to conflict of law rules, and disputes will be brought in the courts there. Any claim must be brought within one year of when it arose.
